If you can answer "yes" to the following, your contract may beat the IR35 rules but it will need other attributes as well:

  • Does your company take business risk?
  • Is your company rewarded by efficiency and sound management in performing a contract?
  • Does the contract allow you to substitute personnel?

If your answer to the following is "yes", your contract may well fall foul of the IR35 rules:

  • Is the contract a "Service Contract" rather than a "Contract for Services"?
  • Are you entitled to sick or holiday pay?
  • Is the relationship between you and your client one of "master and servant"?

It is not merely the contents of the contract that dictates your status but the day to day reality of the way you and your "client" actually work.

IR35 - Who Decides If I am or not caught within IR35?

The burden of deciding if a contract is within or outside IR35 rests with the contractors.  If you need advice in deciding if your contract and practical working arrangements will quality you to act as an independent business (outside IR35), please visit our IR35 Contract Review screen. If you register for our IR35 Solution you will not need to worry about contract reviews at all. You will be paid under PAYE (which means IR35 is not at issue) - but will still retain up to 82% of your income! The solution also includes free professional Indemnity Insurance.

IR35 - Protection against Defence Costs

Whilst we arrange fee protection cover for our contractor clients, if you register for our IR35 Solution, you will not need to worry about an IR35 inquiry. Although you will keep 82% of your income, you will still be paid under PAYE which means IR35 will not be an issue.
